Collaborative law is a new option in Scotland for separating couples to resolve disputes respectfully without going to court.

The process is more open, less adversarial and lays the foundation for a healthier relationship after divorce. It is aimed at anybody who wants to move forward in a positive way, and who wants to avoid court for the benefit of the family.

Benefits include placing the needs of children first and giving them a voice, the process keeps problems and assets confidential, can lead to improved communication, gives control to the couple rather than judges, and it saves time and expense.

There are, however, occasions when court is necessary and our team is well versed in conducting cases in both the Court of Session and the Sheriff Court. Where appropriate, we are also able to secure the services of Advocates of the highest calibre.

The family law team is strategically placed to ensure that their advice is complemented by that provided by other specialists within our private client and financial services team.

Other such advisors include independent financial advisors* providing advice on pension/investment related issues; property experts/estate agents who can provide the best advice in relation to the matrimonial home; taxation advisors who can advise on the tax implications of separation and divorce and trust and succession specialists who can advise on all aspects of estate planning.
